The Same, But Different


Joan Stickley was seriously injured in an automobile accident that killed her husband, the driver.  As a result of her injuries she sought coverage and compensation under their personal auto policy and personal umbrella policy.  Under Maryland Insurance Code, a family member that makes a claim is entitled to the same amount of coverage that a nonfamily member would receive.  The court found that though the personal umbrella policy could provide additional coverage in the event of an automobile accident, the insurance code that guarantees equal coverage for family members and non-family members only applies to a personal auto policy.
