Physically Aggressive Businessman

Kent Bearden pleaded No Contest to criminal charges resulting from a physical altercation with Paul Rasmussen.  When Rasmussen filed a civil suit against Bearden, Bearden sought coverage and defense from his homeowners policy insurer.  The insurance company argued that because of the No Contest plea, the incident could no longer be considered an “accident” as defined by the policy.
