Auto Coverage But Not An Auto Policy


In the state of Maryland, as it applies to “private passenger motor vehicle liability insurance”, insurance code requires an insurer to offer liability coverage to family member is the same amount available to nonfamily members.  When Joan Stickley was severely injured in the auto accident that killed her husband, the driver, she looked to her personal auto and umbrella policies for coverage.  She received payment from the auto policy; however, her claim was denied under the umbrella policy.  A court agreed.  Though the umbrella policy provides auto liability coverage, it is not by definition “private passenger motor vehicle liability insurance”.
