What Is A Vehicle?


Joshua Green died in a boating accident prompting his wife and mother to seek recovery under two Accidental Death and Dismemberment policies.  The insurance company denied the claims because the policies contained an exclusion for accidents while operating any type of vehicle while under the influence of alcohol or any drugs.  The police report and death certificate confirm that Green was legally intoxicated while operating the boat.  Among other arguments, this case examines the definition of the word vehicle.  The court found the language to be unambiguous and broad enough to encompass a boat; therefore, the insurance company properly denied the claim.
